The U.S. Bill of Rights was written more than 200 years ago, but it continues to help Americans today. Written in 1791, the Eighth Amendment still applies to bail bonds in Santa Clarita and across the nation today.
The Legal Information Institute states that the Eighth Amendment reads, “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
“The Eighth Amendment to the U.S. Constitution requires that bail not be excessive,” said Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita. “This means that bail should not be used to simply raise money for the government, or to punish a person for being suspected of a crime.”
A similar clause prohibiting the use of excessive bail in the English Bill of Rights was the basis for the Eighth Amendment to the U.S. Constitution.

Bail was designed to give individuals the chance to be released from jail after being arrested, and to keep their freedom until they are either convicted or exonerated.
In Santa Clarita, the amount of bail is determined by the Los Angeles County Bail Schedule, which is updated annually.
Law enforcement officials check the crime’s bail amount on this schedule to determine the correct bail amount after a person is arrested and charged.
