Many people don’t fully understand what a bail bond actually is, so experts on bail bonds in Santa Clarita explained recently what a bail bonds is, and what it does.
“Bail is money deposited with a bail agent through a bail bonding company or the court to get an arrested person released from custody during their trial,” said Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita. “It serves as a surety, or a guarantee, that the arrested person will make all of his or her required court appearances.”
What’s known as a “face sheet” is the actual contract pledging the guarantee for the defendant’s appearance in court, and the Power of Attorney indicates the pledging surety’s authority to issue the bond, according to the Bail Resource Center & Career Academy.
“A bail bond is the document filed with the court by the bail agent, which tells the court that bail has been paid,” said Chavez. “The combination of the “face sheet” and the Power of Attorney is the bail bond.”

The bail bond agreement runs for the life of the case that is being bonded, said Chavez. This document must be presented to the police or court before the defendant will be released from custody.
The premium — which is 10 percent in the state of California. The premiums are not refundable and are fully earned irrespective of the outcome of the case.

“Most people cannot afford to post a cash bond with the court, which would require their full bail amount in cash,” Chavez explained. “So paying just 10 percent of the cost of the bond to a bail bonding company is often a better option.”
