First, the defendant is responsible for making all of their scheduled court appearances and meeting all conditions set by the bail agent.
“When you purchase a surety bond through a bail agent, that represents your promise to be present at all required court proceedings,” explained Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita.

The person who undertakes the bail, called the indemnitor, must pay the premium cost of the bond, which is 10 percent in California, according to the Bail Resource Center & Career Academy.
The surety bond is exonerated after the trial is over and all conditions have been met, which typically means the entire premium is paid and all court appearances are made.
“The verdict on the case does not affect the exoneration of your bail bond,” Chavez said. “Whether you are found innocent or guilty on your judgment day, your bond will be exonerated after your trial once all conditions set by your bail agent have been met.”

However, the court will forfeit the bail and issue a warrant for the defendant’s arrest if they fail to appear in court or violate their bail conditions.
“If a defendant skips bail, the bail agent will attempt to find them and return them to jail,” Chavez said. “The bail agent has 180 days to locate the defendant before they are forced to pay the full bail amount to the court, which the agent will then seek to recover from the indemnitor.”
