“How is bail set?” This is a common question the public asks bail agents at bail bonding companies like All American Bail Bonds in Santa Clarita.
According to Inessa Chavez, vice president of All American Bail Bonds, judges are responsible for setting bail.
“Most jails have standard bail schedules which specify bail amounts for common crimes,” she said. “This is because most people want to get out of jail immediately, and depending on when you are arrested, it can take a few days to see a judge.”

After an arrest, the arresting agency, like the Santa Clarita Valley Sheriff’s Station, books the person on a certain criminal offense at the jail.
The Los Angeles Uniform Bail Schedule is then used to determine the bail amount.
“Most arrestees can be released from jail on bail,” Chavez said. “Some are not because the arresting agency feels the person is a flight risk or a risk to public safety, or if the crime allegedly committed is a capital offense.”

The bail amount can range from thousands to millions of dollars, depending on the charges, and can be raised or lowered in court depending on the case.
“The Eighth Amendment of the U.S. Constitution requires that bail not be excessive,” Chavez said. “The amount of bail should be no more than is reasonably necessary to keep the arrestee from fleeing before a case is over.”
