In order to offer surety bonds — a type of bail bond– to the public, the surety insurance company and the State Department of Insurance must function in a working relationship with each other.
According to the Bail Resource Center & Career Academy, the surety insurance company behind the bond employs both general and bail agents to insure the back amount of the bonds.
The general and bail agents interact with employees of the State Department of Insurance, known as bail solicitors and bail permittees, in an ongoing licensing relationship.
The general agent from the surety insurance company providing the bond acts as a middleman between the agent and the surety company.

The bail solicitor functions as an agent and is permitted to execute bail on behalf of the Department of Insurance and as an employee of the holder of a bail license.
The bail permittee provides their own surety and is permitted to solicit, negotiate, issue and deliver bail bonds without the need for insurance because they are independently financially responsible for putting up their own money to provide surety.
Because they are financially independent, the bail permittee can write a bond at any rate and can also function as a bail agent.

The licensing relationship between the surety insurance company providing the bond and the Department of Insurance is primarily governed by penal code, administrative/civil code, insurance code and local laws.
Each officer, director, stockholder and employee from the bail agency corporation providing the bond is required to hold a current individual bail agent license, and the corporation may not employ a bail solicitor or permitee.
