One of these penal codes is California Penal Code 1303, which states, “If an action or proceedings against a defendant who has been admitted to bail is dismissed, the bail shall not be exonerated until a period of 15 days has elapsed since the entry of the order of dismissal,” according to a California Bail Education textbook.
“This means that if the charges against a defendant are dropped, the bail amount should not be dropped for 15 days,” said Inessa Chavez, vice president of All American Bail Bonds in Santa Clarita. “During the 15 days, if the suspects allegedly commits the same crime, the bail will then be applied to the new offense.”
The second penal code that applies to bail agencies, including All American Bail Bonds in Santa Clarita, is California Penal Code 1305.
If a defendant misses their court date for their arraignment, trial or judgment, their bail would be forfeited, according to the code.
“We deal with this penal code when when a defendant is bailed out and they skip their court date skip town or even leave the country,” Chavez said.
Penal Code 1305 goes into depth and describes how judges can handle different outcomes of the situation.
